Parkora Terms of Use
English is the master legal version.
1. General Provisions
- These Terms of Use govern the use of the Parkora mobile application.
- By using the application, the user confirms that they have read, understood, and fully accepted these Terms.
- If the user does not agree with these Terms, the user must stop using the application.
- The Company may change the application functionality, service content, and these Terms at any time without prior notice, unless otherwise required by the laws of the United Arab Emirates.
2. Service Description
- The Parkora application provides users with auxiliary tools for creating SMS requests, reminders, and informational notifications related to parking payment.
- The application is not an official government parking payment system and does not process payments on behalf of RTA or Parkin.
- Some application features may require an internet connection, access to geolocation, SMS functions of the device, and other system permissions.
3. User Rights and Obligations
The user agrees to:
- provide correct and up-to-date data;
- use the application only for lawful purposes;
- independently verify the correctness of the SMS, parking zone, and vehicle data before sending;
- not use the application for fraudulent, illegal, or harmful actions.
The user is prohibited from:
- interfering with the operation of the application;
- attempting to obtain unauthorized access to servers or data;
- using automated means to access the service;
- violating applicable laws of the United Arab Emirates.
4. Limitation of Liability
- The service provides informational notifications and reminders and is not an official government parking payment system.
- The user is independently responsible for checking the correctness of entered data, parking status, and successful payment.
- The Company is not liable for fines, losses, or other expenses arising from non-receipt of a notification, delayed notification, technical failures, or user errors when entering data, including vehicle plate number, parking zone code, or parking duration.
- Parkora's liability is limited to the extent permitted by applicable laws of the United Arab Emirates.
5. GPS / SMS Disclaimer
- The accuracy of parking zone detection depends on GPS and geolocation services of the user's device and may differ from the actual location.
- The Company does not guarantee geolocation accuracy or uninterrupted operation of GPS, mobile network, or internet connection.
- Delivery of SMS messages and confirmations depends on telecom operators and external services, including Etisalat, du, and the Parkin (RTA) system.
- The Company does not guarantee receipt, timely delivery, or correct processing of SMS confirmations.
6. Third-Party Status
- The Parkora application is an independent service and is not affiliated with, connected to, or endorsed by the Roads and Transport Authority (RTA) or Parkin PJSC, unless expressly stated otherwise.
- All trademarks, names, and references to third-party organizations belong to their respective rights holders and are used for informational purposes only.
7. Payment Confirmation and SMS Use
- The Parkora application creates an SMS message for parking payment, but does not debit funds and is not a payment operator.
- Before sending an SMS, the user must independently verify all data, including vehicle plate number, parking zone code, and parking duration.
- Payment is considered successfully completed only after receiving an official SMS confirmation from the Parkin/RTA system.
- By pressing the "Pay" button, the user confirms that they have checked the entered data and understand that the application acts only as an auxiliary tool for creating an SMS request.
8. Subscription & Refund Policy
- Some application features may be provided on a paid subscription basis.
- The subscription price, term, and available features are displayed in the application before subscription purchase.
- The subscription renews automatically unless the user cancels it no later than 24 hours before the end of the current period.
- The user manages and cancels the subscription through Apple App Store or Google Play according to the rules of the relevant platform.
- Unless otherwise required by applicable UAE law or platform rules, paid subscriptions and payments are non-refundable.
- The Company is not responsible for fees, charges, or refund terms set by Apple, Google, mobile operators, or other third-party payment services.
- All payments are processed by the relevant platform (Apple App Store / Google Play), and the Company does not store users' payment data.
9. Privacy Policy
- The application may collect and process user data, including phone number, vehicle plate number, geolocation data, device information, and data necessary to provide service functionality.
- The Company takes reasonable technical and organizational measures to protect personal data from unauthorized access, loss, alteration, or disclosure.
- Personal data is not sold or transferred to third parties except where necessary for service operation, compliance with UAE law, or processing user requests.
- By using the application, the user consents to the processing of personal data in accordance with these Terms and applicable UAE law, including the UAE Personal Data Protection Law (PDPL).
- The Company may use anonymized and aggregated data solely for analytics, service improvement, and application security.
10. Intellectual Property
- All rights to the Parkora application, including software code, design, interface, logos, text, graphics, databases, and other materials, belong to the Company or are used on lawful grounds.
- The user receives a limited, non-exclusive, non-transferable right to use the application solely for personal, non-commercial purposes.
- The user may not copy, modify, distribute, or sell the application or its parts; decompile, disassemble, or attempt to obtain the application source code; or use the application in violation of UAE law.
- Any unauthorized use of the Company's intellectual property may result in liability under UAE law.
11. Account Suspension / Termination
- The Company may temporarily restrict or fully terminate a user's access to the application without prior notice in case of violation of these Terms, fraudulent, illegal, or suspicious activity, actions that threaten the security of the application, users, or third parties, or requirements of government authorities or applicable law.
- The user may stop using the application at any time by deleting the application and cancelling the subscription through the relevant platform.
- Termination of access to the application does not release the user from obligations that arose before the termination of service use.
12. Force Majeure
- The Company is not liable for full or partial non-performance of obligations caused by circumstances beyond the Company's reasonable control, including communication, internet, GPS, or mobile operator failures; interruptions in RTA/Parkin services; actions of government authorities; cyberattacks, technical failures, power outages; natural disasters, emergencies, wars, epidemics, and other force majeure circumstances.
- During force majeure circumstances, performance of the Company's obligations may be suspended without liability for possible user losses.
13. Disclaimer of Warranties
- The application is provided on an "as is" and "as available" basis.
- The Company does not guarantee that the application will operate uninterrupted or error-free, that the service will be available at all times, that application functions will meet the user's expectations, or that errors or technical failures will be corrected immediately.
- The user uses the application at their own risk to the extent permitted by UAE law.
14. Changes to Terms
- The Company may change or update these Terms at any time.
- The current version of the Terms is published in the application or on the Company's official website.
- Continued use of the application after publication of updated Terms is deemed the user's consent to such changes.
15. Governing Law and Dispute Resolution
- These Terms are governed by and interpreted in accordance with the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai.
- All disputes, controversies, or claims arising in connection with the use of the Parkora application are subject to the exclusive jurisdiction of the courts of the Emirate of Dubai, UAE.
